Tax Law Advisory Services

Advisory services are provided with due regard to the legal and financial structures of companies, focusing on the tax implications and potential risks associated with commercial transactions. Within this scope, support is offered in identifying and implementing corporate reorganization models—including mergers, acquisitions, full or partial demergers, changes in legal form, and asset transfers—in compliance with both corporate and tax legislation.

Additionally, guidance is provided on potential tax disputes, current regulatory developments are monitored, and tax risks arising from business operations are assessed as part of the advisory services.

Where necessary, balance sheet analyses are conducted under the Turkish Commercial Code No. 6102 to determine situations of technical insolvency or over-indebtedness, and legal remedies aimed at addressing such financial conditions are evaluated, taking into account their tax implications.

Legal Support in Tax and Customs Disputes

Legal support is provided throughout the entire lifecycle of tax audits—from initiation to the resolution of any resulting tax disputes. This includes technical assistance during audit proceedings, legal and technical review of audit reports, filing applications with the Report Evaluation Commission (Rapor Değerlendirme Komisyonu), and guidance during pre- and post-assessment settlement procedures.

In cases where settlement is not reached, assistance extends to the management of judicial proceedings before administrative courts and, where applicable, the handling of individual applications before the Constitutional Court.

With respect to customs matters, legal support also covers the preparation of objections against supplementary assessments and administrative fines issued following customs audits, follow-up of objection procedures, and representation throughout all judicial stages of customs-related disputes.
